The cybersecurity company has filed a patent infringement complaint in Texas asserting two patents covering runtime memory-corruption detection and correction, with Microsoft security documentation among the exhibits.
Cybersecurity company Virsec Systems, Inc. has filed a patent infringement lawsuit against Microsoft Corporation in the US District Court for the Western District of Texas, asserting two patents relating to the detection and correction of memory corruption during program execution.
Filed on October 16, 2026, the case is listed as Virsec Systems, Inc. v. Microsoft Corporation, No. 1:26-cv-02934. The public docket identifies the action as a patent infringement case under 35 U.S.C. § 271 and records that Virsec has demanded a jury trial.
The complaint includes the asserted patents, separate claim charts, and Microsoft documentation relating to Windows security features. The filing brings questions about patent protection for runtime security technologies into focus, although the infringement allegations have not been adjudicated.
Two patents at the heart of the dispute
Virsec asserts US Patent Nos. 8,966,312 and 10,331,888, both titled System and Methods for Run Time Detection and Correction of Memory Corruption. The patents concern technology for detecting and correcting memory corruption while software is executing. Memory corruption can create vulnerabilities that attackers may exploit to interfere with program execution or compromise system security.
The docket lists a claim chart for each asserted patent. It also identifies two Microsoft Learn documents among the complaint’s exhibits: Kernel-mode Hardware-enforced Stack Protection and Override Process Mitigation Options.
Their inclusion indicates that Microsoft’s published security documentation forms part of the material submitted with the complaint. However, the docket listing alone does not establish precisely how Virsec maps individual patent claims to specific Windows features, or which products and functionalities it alleges infringe.
Cybersecurity and software patent protection
The dispute highlights the intersection of patent rights and operating-system security, an area of interest to cybersecurity companies, software developers and intellectual property professionals.
Runtime memory protection and process-mitigation mechanisms are designed to help address software vulnerabilities. Patent disputes involving such technologies can raise questions about the scope of claimed inventions, the implementation of security features and the boundaries of competing technologies.
In this case, the precise relationship between the two Virsec patents and Microsoft’s security mechanisms will depend on the infringement allegations and the claim charts submitted with the complaint. The filing itself does not establish that Microsoft has infringed either patent.
What happens next?
The docket records the complaint, a request for issuance of summons, a notice concerning the filing of a patent/trademark form, and a Rule 7 disclosure statement, all dated October 16, 2026.
The next developments to watch include service of process, Microsoft’s response, and any subsequent arguments concerning infringement or patent validity. Further assessment of the dispute requires review of the complete complaint and both claim charts to establish the specific infringement theories and remedies Virsec is pursuing.
