ByteDance (TikTok) joins the Open Invention Network 2.0 community

Open source software is the engine for almost every enterprise stack. Open Invention Network (OIN) was created to safeguard open source from bad actors. Over the last two decades, open source has been able to flourish, driving innovation in the software market to levels previously imagined. OIN protects the foundational open source technologies powering Linux to Python, and everything in between. That means it covers technologies that span cloud computing, networking, banking, communications, and AI, among many others.

The OIN protects essential open source technologies by facilitating freedom to operate in a patent cross-licensing network. Its community consists of more than 4,000 businesses and organizations. The coverage area or scope of the OIN community cross-license is defined by a list of software platforms and components called the Linux System definition.

Earlier this year, OIN transitioned to OIN 2.0. This transformation led to two major changes. OIN moved to a tiered, revenue-based annual subscription model. Small businesses and individuals participate for free. Medium and large enterprises now pay annual fees to sustain the community’s mission.

OIN also updated its license agreement to cover new tables of software platforms and components addressed by its Linux System definition. The expansion, housed in a new Table 13, reaches well beyond the Linux kernel into the cloud-native and edge stack technologies that enterprises actually deploy.

The upgrade is opt-in. Companies that joined under the original OIN 1.0 framework keep free coverage of the older tables, but they are not moved to 2.0 automatically. To gain the expanded protection – and, for large firms, to help fund it – an existing member must actively sign the new agreement.

That is what makes ByteDance‘s commitment notable. The TikTok parent first joined OIN in 2021, pledging patent non-aggression around Linux and adjacent open source software. Joining OIN 2.0 is a deliberate act, not a legacy default. It extends the pledge to the cloud-native components ByteDance’s own infrastructure runs on, and it lends the weight of one of the world’s most valuable technology companies to OIN’s new funding structure.

Every large, patent-rich company that opts into OIN 2.0 strengthens the collective shield protecting open source from litigation. ByteDance’s participation adds both its portfolio and its credibility to that cause.
